Career Summary:

John SL Morgan is a mining consultant with extensive experience in both surface and underground mining, for the extraction of metalliferous ores, coal and industrial minerals. He has a degree in Mining Engineering from the Royal School of Mines.

Morgan founded Morgan Worldwide Consultants Inc. (MW) in 1995. Previously he had established Morgan Mining & Environmental Consultants, Ltd. (MMEC) which was acquired by an international mining consulting company Weir International Mining Consultants (WIMC) in 1992. Morgan served as its Executive Vice President until 1995, when he left to form MW.

Morgan has been the project manager on a number of mine technical reviews, mining operation appraisals, a significant number of subsidence investigations and reviews of the environmental compliance and liability analyses for both operating and abandoned mining operations. He has been actively involved in projects worldwide including; Indonesia, Russia, Ukraine, Poland, Bulgaria, Romania, Peru, and Trinidad, he has also worked in all regions of the United States. During his career, Morgan has worked in South Africa, and as a mine planning engineer for an open cast coal site in Britain.

Prior to attending university Morgan served as a Lieutenant in the 3rd Royal Tank Regiment and subsequently as a troop commander in the Royal Monmouthshire Royal Engineers.

Project Experience:

Project Management Experience

» As part of a project team with Ernst & Young, Morgan has provided technical assistance to the Petrotrin, Trinmar SBU the offshore oil company of Trinidad and Tobago. These services include the development and implementation of a project management approach to improve the performance of special projects. Morgan also provided technical support to the project teams in order to enhance the contracting, scheduling, monitoring and interrelationship of projects.

Specific services included the assistance in the development, evaluation and award of an $8.7M contract for a new workover drill rig. Morgan also assisted Trinmar in the evaluation, analysis and negotiation of a $770M contract for the development of a portion of the lease block. Other services included a comprehensive evaluation of the offshore transport system, the preparation of a needs assessment and contract documents for a new vessel fleet.

» Project Manager for the Arkansas Department of Parks and Tourism of a feasibility study to evaluate the commercial diamond mining of the Crater of Diamonds State Park. This task included the preparation of the Request for Proposals and the Evaluation Program Agreement which was advertised internationally in order to interest major mining companies in participation in the site evaluation and possible mining of the reserve.

Morgan's involvement in Phase I of the testing included preparation of technical specifications and selection of contractor for the drilling plus construction management during the drilling program.

He prepared the ATemporary Non-Conforming Use@ application to the U.S. Department of Interior for the Phase II bulk sampling program. He prepared the contract documents for the bulk sampling and testing and managed the $3.2m Phase II evaluation program.

Morgan was responsible for the detailed site management for the excavation of the 9,000 ton bulk sample plus the processing of the sample through heavy media separation and X Ray ASortex@ equipment. Other activities included contract management, full financial control and final reporting on the Evaluation Program including the economic valuation of the project.


Project Evaluation Experience

» On behalf of the European Bank for Reconstruction and Development (EBRD) conducted an evaluation of the Business Plan developed by an independent granite producer in Central Ukraine to determine the suitability of the proposed quarrying operation to receive funding from EBRD.

» Conducted a review of the dimension stone industry in Ukraine for the European Bank for Reconstruction and Development (EBRD). The objective was to determine the feasibility of consolidating quarrying and processing facilities as part of an industry rationalization and restructuring and the suitability of the restructured company to receive an EBRD loan. Services included preparation of market projections, capital expenditures and financial forecasts plus a valuation of the company

» Reserve modeling of a coal property in West Virginia to determine the potential reserves that could be extracted by the combination of secondary contour mining, augering and the use of highwall miners. The analysis accounted for previous mining and access restrictions plus the physical constraints of each selected mining method.

» Evaluation of the logical mining unit and federal due diligence requirements relating to the Trona leases controlled by Church & Dwight. The task included detailed review of the Trona lease geology available geologic information and current mining practices. The assignment included preparation of conceptual mine plans and estimated capital and operating costs.

» Evaluation of the projected mine plans, reserves and physical condition and location of the assets of a mining company in West Virginia plus an evaluation of the environmental and reclamation liabilities in order to determine the financial exposure and risk of a lending group.


Environmental Services

» Completed an environmental liability determination for Petrotrin, Trinmar Strategic Business Unit in Trinidad to determine the liabilities associated with the closure of the operations including wells, offshore structures, pipelines and shore facilities. Tasks included review of historic files to define quantities for each closure item. The liabilities were calculated in accordance with International Accounting Standard (IAS) 37.

» Participated in the environmental audit of coal mines in Russia as part of the World Bank Coal Restructuring program. Tasks included detailed audit of Vorkutinsky Mine in the Vorkuta region of northern Russia and Chertinskaya Mine in the Kuzbass region of Siberia. Additional tasks including development of environmental management practice for the restructured industry and presentation in an environmental workshop.

» Provision of technical assistance in the negotiation and resolution of the issues relating to the contour mining operation on Black Mountain in Southeast Kentucky.

» Member of the quality control advisory committee to the West Virginia Division of Environmental protection to evaluate the permitting program and to advise the Secretary of the performance of the program and areas of required improvement.

» As part of the World Bank=s mine closure program for Romania was senior lecturer for the Training Program for Mine Closure and Environmental Remediation for the Project Implementation Unit of the Central Group for Mine Closure. The mine closure training included detailed presentations on current worldwide best practices for: subsidence mitigation, shaft and adit closure, decommissioning and demolition of surface facilities, health and safety, determination of post closure liability and long term safety of mine closure

» Member of the US EPA Environmental Impact Assessment team evaluating the long-term impacts and options relating to the regulation of mountaintop mining. Analysis included review of economic effects of various regulatory restrictions on valley fill sizes

» As part of the restructuring and privatization process completed an Environmental Review of the mining and processing operations of PT Aneka Tambang in Indonesia. The review included detailed analysis and recommendations of the environmental performance of the Bauxite, Ferro Nickel, Iron Sand and Gold operations of the company. The implementation phase of the project included development and monitoring of detailed construction schedules for the upgraded environmental program; the program included hydrologic design, integrated mine planning, revegetation, hazardous materials handling and the development of Environmental Policy.

» Conducted an Environmental Assessment of the Crater of Diamonds project in compliance with National Environmental Policy Act (NEPA) requirements in order to demonstrate to the US Department of Interior that the proposed action did not have a significant effect and that a FONSI could be granted. After review of the EA a FONSI was granted.

» As part of the privatization process leading to an IPO for PT Bukit Asam in Indonesia conducted an Environmental Review. The review included analysis of the environmental performance and definition of current liabilities of the producing coal mines in Tanjung Enim and Ombilin plus the three coal ports. Subsequent to the review Morgan managed the development and implementation of the Environmental Action Plan to upgrade the environmental compliance of the company. This Plan included detailed hydrologic designs, upgraded mine planning, revegetation procedures hazardous material handling and waste disposal plus training of operating personnel.

» Completed an Environmental Review of the environmental practices of the Russian Coal Industry and the regulation applicable to the industry. The assignment included a presentation to the World Bank team regarding the key environmental problems and their off-site effects. As part of the project, Morgan undertook site review of surface and underground operations of Kuzbassrazrezugol, Leninskugol and Rostovugol.

» Prepared an Environmental Assessment including a review of the environmental compliance of the underground and surface mining operation of Bobov Dol and Marbass Coal Companies in Bulgaria plus a determination of the environmental effects caused by the mine and processing facilities on surface water, groundwater, subsidence and air quality. He developed a strategy for minimizing off-site effects of mining and for progressing toward acceptable environmental practices.

» Conducted an Environmental Review as part of the privatization of the operations of Minero Peru. Review of the San Antonio de Poto gold operation, the Cerro Verde copper mine, the Cajamaquila zinc refinery and the Ilo copper refinery

» Evaluation of the environmental compliance of operations of a major coal producer in the Illinois Basin and Central Appalachia in order to determine their reclamation liabilities. This task was part of their annual audit.


Aggregate and Dimension Stone Experience

» Preparation of a bankable Business Plan for the acquisition of an ongoing surface limestone mine in Northern Kentucky. Following acquisition was the project manager for the further development of the 1.4 million ton per annum quarry including life of mine plan, permit revision and new equipment fleet purchase. Ongoing services to review and optimize production.

» Professional witness for the review of a sand and gravel operation in California to determine the economic effects on the operation of a Ataking@ of a portion of the mining companies reserves. Services included a valuation of the operation under the two property ownership scenarios and development of an optimized mining method.

» Feasibility study for a new underground limestone mine in Northern Kentucky with the specific focus on minimizing the environmental impact by locating the of the crushing, screening and stockpiling activities underground, plus the development of a barge rather than truck loadout. Additional services included detailed mine design and preparation of the applicable zone change application.

» Detailed design and economic evaluation for a green field underground limestone mine in Northern Kentucky Tasks included submittal of Stage II zoning application, design of surface processing facilities, design of underground development and supervision of detailed exploration program.

» Preparation of a Business Plan for the development of a marble quarry in NW Alabama. Subsequent services included development of operating budgets, overseeing permit application process and monitoring of ongoing quarrying activities including negotiation of equipment leases / purchases and preparation of a valuation of the reserves

» Assistance to an underground limestone producer to develop a new underground operation in Northern Kentucky. Services included review and development of planning controls associated with potential subsidence, blasting vibration, noise and dust. Additional services included revisions to the permit application in order to address local environmental concerns. Other associated services included the valuation of the limestone reserves of the operation for the lending institution.

» Valuation of the damages incurred by an aggregate producer in Oregon due to the use of the quarry as a storm water retention facility.

» Review of an aggregate producer in Oregon to develop an optimized mine plan for a new operation including specific environmental mitigation measures for noise and the use of dredging equipment.

» Completed a restructuring analysis of the quarrying and aggregate industry in Trinidad and Tobago including a detailed technical audit of National Quarries plus an Environmental Assessment of the industry. The study included a determination of current and future markets, determination of the economic reserves plus an analysis of import/export potential. Recommendations included a privatization strategy, regulatory framework and technical improvements.

» Valuation of the limestone reserves in southern Ohio to assist landowner in negotiations with adjacent limestone producer.

» Provision of consulting services to the City of Lenexa, Kansas to evaluate limestone-mining applications and to prepare a mining ordinance for the City.

» Completion of a comprehensive limestone-mining ordinance for Lexington Fayette Urban County Government. The ordinance included detailed standards for blasting, mine stability, surface water hydrology, site reclamation and reporting.

» Expert witness testimony regarding the effectiveness of the Kentucky non-coal regulatory program and its application to a specific limestone mine permit. The case lead to major revisions to the Kentucky program. Subsequent activity included the review of the permit application and the development of site specific permit conditions including noise surveys.


Coal Mining Experience

» Development of a mine design for a surface operation in Central West Virginia, that minimized stream impacts by design of a stream relocation and creative backfill configuration. The development of the mine design included review meetings with the US EPA and US FWS in order to obtain approval of the innovative concept as causing minimal impact.


Mine Subsidence Experience

» Conducted a peer review of the ongoing projects in Rock Springs to model the geology of the mined area plus analysis of potential residual subsidence and effect of grouting effort. Review also included analysis of contractor performance.

» Development of a drill and grout project for the Wyoming Department of Environmental Quality which involved the design and contract management for the reclamation of numerous underground coal mines under Rock Springs, in southwestern Wyoming. Morgan's role of project manager includes preparation of bid packages, CADD compiled designs, grout design and subsidence potential evaluation; plus the management of the full time construction management activity. This project had a total estimated construction cost of $12 million. The project was awarded the 1995 Abandoned Mine Land Reclamation Award by the U.S. Department of the Interior.

» Project Manager for the design of a grouting plan to reinforce the existing gate road pillars in order to minimize subsidence effects on a high voltage transmission tower. The project included detailed design construction documents, contractor selection and construction management.

» Review of structural damage to a manufacturing facility in Eastern Kentucky to evaluate the contribution of mine subsidence related damage. Overall evaluation of the costs of ongoing maintenance and repair due to the subsurface conditions. Inclusion of the subsidence impacts into the valuation of the property.


Expert Testimony Experience

» Expert witness testimony and permit review relating to the effects of the mining conducted by Delbarton mining on the ground water users in the area following reports of water loss. Services included detailed review of the probable hydrologic consequence (PHC) documentation, review of the cumulative hydrologic consequences analysis (CHIA) prepared by the state plus detailed review of the mining plan and mining sequence.

» Expert witness testimony relating to the analysis of offsite dust impacts on a community from the expansion of an adjacent coal processing facility. Analysis included detailed review of mine permitting activity and air quality permitting actions plus determination of Best Available Control Technology.

» Expert witness testimony and technical support in the litigation relating to the mountaintop mining and valley fills in West Virginia. The services included testimony in Federal Court plus preparation of various expert reports. Additional services include the development of an excess spoil disposal optimization process.

» Evaluation of the interaction of surface blasting on an adjacent underground mine to determine the potential effects on the remaining mine support system. Provision of expert witness testimony in support of the case.

» Expert witness testimony and analysis for the evaluation of off site impacts caused by a coal preparation facility in eastern Kentucky

» Expert witness testimony and analysis for a construction claim relating to the grouting of mine voids under a new sewage treatment basin in Iowa in order to prevent potential subsidence effects

» Expert witness testimony relating to the causes of damage to a property in Southern Indiana and the reasons why it was not mining related.


Mine Security Experience

» As part of the re-structuring program of PT Aneka Tambang Morgan was the Project Manager for the evaluation of the security procedures associated with the Logam Mulia gold refinery and the Pongkor gold mining operations. Following the evaluation Morgan was responsible for the development and implementation of a comprehensive security program consisting of physical structural improvements, surveillance cameras, alarm systems, access control and product accountability systems.

» As a component of the Crater of Diamonds Evaluation program Morgan was responsible for the development of a security program. The security program was designed to prevent any loss of diamonds from the processing plant and sorting process but also to ensure that there was no Asalting@ of the samples. The security program included an audit of the facility, the upgrade of the security systems plus the development of a contract document for the selection of a security contractor.. During the bulk testing program Morgan was responsible for the management of the fulltime security team


Mine Reclamation Experience

» Evaluation of the potential of combining power plant scrubber sludge, flyash and bottom ash into a pumpable grout that could be disposed of in an adjacent abandoned underground workings. The review included economic analysis of the project plus bench scale testing of grout mixes and leachate potential.

» Compilation of a surface mine drainage handbook for the State of Maryland. The project includes liaison with State and Federal agencies, plus with the local coal operators to ensure the optimum mix of design and calculation approaches.

» Management of the design and construction for the reclamation of the abandoned Horse Creek limestone mine in southeast Wyoming. The mine excavated two near vertical limestone beds using shrinkage stoping and was experiencing crown pillar and hangingwall failure. The project was for the selective backfilling hangingwall reduction and crown pillar stabilization.

» Management of the evaluation, design and construction of a stream improvement to rectify the stream capture by an abandoned underground limestone mine in southeast Wyoming. The design included the installation of an impervious liner, geotextile and rip rap adequate to pass a 100 year storm event.

» Management of the Crawford Mountain reclamation project for the State of Utah to determine the optimum method of reclaiming the abandoned phosphate operations that were experiencing crown pillar subsidence and failure. The design analysis included underground review of the operations as well as inventory of all hazards. Designs for each construction package included underground closure of crosscuts.

» Management of a cooperative agreement funded project between the Office of Surface Mining and the States of West Virginia and Maryland to review the sources of acid mine drainage in the North Branch of the Potomac river. The project included the development of a routing model that allowed the effect of various remediation approaches to be prioritized.

» Management of the site evaluation and reclamation design of the Widen reclamation project which consisted of a 4.5 million cubic yard burning refuse pile, plus two coal slurry impoundments.

» Management of the site evaluation and design of two coal mine reclamation projects in Oklahoma, including highwall reduction and significant drainage modeling.

» Management of five reclamation projects for the Kentucky Division of Abandoned Lands.

» Management of nine reclamation projects for the West Virginia Department of Energy.

» Provision of technical services to the Oklahoma Department of Mines, including the organization and presentation of a seminar on the Oklahoma permit process plus the technical review of submitted surface mining permits.
